Committee on Fundamental Rights and Directive Principles
To make the constitution making process systematic and regular in thematic form, the Rule 66(1) of the Constituent Assembly Rules, 2065 (2008) has contained the provision to form a Committee on Fundamental Rights and Directive Principles. As per the provision of the Rules, a 43 member- committee on Fundamental Rights and Directive Principles was formed on 15 December 2008 and the committee was reformed by the CA on 10 January 2009 and on 19 January 2009. The Chairperson of the Committee is Hon. Binda Pande. The committee has the mandate to prepare a list of activities to be carried out on the concerned subject, to collect relevant materials on the subjects and to conduct discussions and studies and prepare a preliminary draft, including a concept paper with technical advice from specialists on the subject under the working areas of the Committee. In this way, on the basis of given mandate, the committee has submitted the draft report including a concept paper on 4 November 2009, and CA has already completed the discussion on the report. The Rule 66(1) of the Constituent Assembly Rules, 2065 (2008) has given the following mandates to the committee to submit the report by preparing the preliminary draft along with concept paper on the subjects assigned to individual Committee:
· Identification of fundamental rights
· Grounds of restrictions on fundamental rights
· Provisions relating to implementation of fundamental rights
· Directive principles and policies of the state
· Provision relating to special protection of rights of all minority communities including women, children, youths, laborers, peasants, madhesi, indigenous/ tribal communities, dalit, backward regions, incapacitated persons, Muslims
· Provisions relating to citizenship
· Other necessary matters relating to the working areas of the Committee
